The word “we” or “us” refers to Yearbook Labs Company for the remainder of this document while “you” or “yours” refers to you, the user. “Material” refers to any images (digital or analogue), video, or writing (hand written or electronically submitted documents).
The terms in this document govern your use of our services. By using our services, you agree to our terms. Furthermore, the Privacy Policy covers how we treat material submitted to us. If you are reading on behalf of your institution or company, your agreement represents the agreement of your institution or company. You also agree to legal conditions of your institution or company while doing so.
One Account Per User
Each user (i.e. individual) is allowed to have only one (1) non-guest account on Yearbook Labs. Users who create multiple accounts risk having their duplicate accounts removed without warning.
Geographical and age restriction
We intend our users to reside in Canada and the United States. We do not prevent users residing in other countries from using our services, though we are not obligated to provide support to those users or obey the laws of those countries.
Non-guest accounts: If you are not 18 years of age or above when signing up, please obtain permission from your parent or guardian.
Guest accounts, including sub-accounts for GradForms+ and Ichipoll: No age restrictions.
Copyright
We take copyright seriously. The material you submit must either be yours or covered by Fair Dealing. If it's yours, then you maintain ownership. If it's not, and it's not covered by Fair Dealing, then please make sure that you have permission from the copyright owner of the material. In the US, Fair Use laws supersede Fair Dealing. Either way, we do not take responsibility of copyright infringement by our users.
Please be aware that materials infringing copyright will be removed without warning. Please also be aware that the same rules apply to materials other users submit on your forms.
Permissions
By using our services, you grant us permission to treat your material in manners covered in the Privacy Policy.
Acceptable Use
We provide services in the hopes that you will use them reasonably. Abusing bandwidth and disk space (e.g. not using them for stated purposes) will result in the termination of your account after at least one (1) warning.
Responsibility
You take responsibility for your actions when using our services. We, as well as our hosting provider, will not be liable for negative consequences arising from your actions.
You take responsibility of users submitting material using forms you create on our services. Therefore, their infringements are your infringements. Please lay out the rules clearly for them so you do not end up violating our terms.
If you are using your forms in an academic institution setting, we have drawn up a brief TOU for students and parents. You should supplement it by including your own terms on your forms.
No spam
Our services allow you to send emails to other users. We have a zero-tolerance policy against spam. All spam reports will be investigated. Spammers are advised that their accounts will be closed without warning. All decisions are final.
Spam messages are messages sent to a large number of recipients that are of no use to the majority. Please evaluate your messages against this criterion in order to avoid sending spam.
As-is
All services are provided as-is. We will assist you to the best of our ability to resolve issues, but issues out of our control (e.g. with our hosting provider) are not our responsibility. Except when prohibited by law in your place of residence, we make no warranties about our services.
Billing
We make clear how much, and how, you will be billed. We will also make clear to you changes in billing at least thirty (30) days in advance. Automatic renewals are valid until you explicitly cancel them. You are also responsible for applicable taxes (see below).
All prices are listed in Canadian dollars. Users residing in the United States should be aware of the exchange rate when purchasing.
Sorry, no refunds or exchanges.
Tax Policy
Canada (except HST provinces): The GST will be added upon checkout. The PST or QST, if applicable, is included in the listed prices.
Canada (HST provinces only): 5% of the listed prices will be added upon checkout as part of the HST. The rest of the HST is included in the listed prices.
USA (sales tax is 5% or greater): 5% of the listed prices will be added upon checkout as sales tax, or part of sales tax. Please file the rest of the sales tax on your own, if applicable. The listed prices do not include sales tax.
USA (sales tax is less than 5%, or when purchasing during a tax holiday): You will be charged 5% of the listed prices additionally. Please email us for a tax refund.
Disputes
You agree to resolve disputes with us informally by contacting us. You agree to bring disputes to court only if they are unresolved fifteen (15) days afterwards.
Termination
You are free to stop using our services at any time. To delete your account, please contact us.
If you are not abiding by our terms, we reserve the right to suspend or delete your account after at least one (1) warning.
If you have not used our services in at least twelve (12) months, we reserve the right to delete your account after at least one (1) warning.
Miscellaneous
Except for file transfers via Message Center or GradForms Messenger, we use base-2, not base-10, units for calculating storage space (i.e. 1 MB on Yearbook Labs is 1024 KB, not 1000 KB).
These terms are subject to change. You will be notified at least seven (7) days in advance. These terms supersede all previous versions. In the event that these terms conflict with information found elsewhere on our websites and services, these terms prevail.
Yearbook Labs Company abides by British Columbian and Canadian law, except for the "As-is" clause above.

The parties acknowledge and agree that the above agreement be drawn up in the English language. Les parties reconnaissent et confirment par les présentes qu’elles ont exigé que la convention présente soit rédigée en langue anglaise.

“Publication” refers to the yearbook, and any ancillary productions related to it, including, but not limited to, slideshows, video compilations, etc.
You maintain ownership of any material that you submit to us. Your institution will only use submitted material for its stated purpose, and for appropriate audiences. Typically, the audience will include (but is not limited to) students, their families, and attendees at any school grad or awards function. Reproduction of any submitted material will be limited to yearbooks, or for use in school based ceremonies. Material will not be shared with any other third party unless you give consent to your institution in writing.
We will not use any material you submit commercially.
Submitted written material may be edited for brevity by the institution, while all efforts will be made to maintain the intent of the material.
Videos or images may be edited by the institution for size or length to fit in the publication.

QUICK FACTS

- The data you enter is kept right here, locally: in Canada and the U.S.
- While we collect certain data, such as browser versions, to help improve our services, we have no access to your IP addresses.
DROPCALC, AVAILABILITY, AVAILABILITY PRO, AND WONDERDROID X ONLY
- DropCalc connects to the Internet to display ads. Please refer to AdMob's policies for more information.
- Availability, Availability Pro, WonderDroid X, and WonderDroid Ultra: This app does not connect to the Internet and, therefore, we do not collect any data using this app beyond what Google provides when you install this app, such as device language, country, etc.
- WonderDroid Ultra: In addition to Google Play statistics mentioned in the last point, this app allows you to download game cover art over the Internet. Game titles are submitted to third-party services laid out in OpenVGDB. This feature is optional. Otherwise, Yearbook Labs does not collect any data.
- Other parts of this privacy policy do not apply to DropCalc, Availability, and Availability Pro.
MEAT: This app connects to our online service in order to generate a GIF of meeting times. Data, including meeting times, submitted to Facebook are covered by their Data Policy.
Your privacy is important to us. In this document, we outline how we (Yearbook Labs Company) collect, use, communicate, and disclose information.
Our website infers the country that you reside in through geolocation services hosted at www.ipinfodb.com in order to provide content customized to your country. You are free to spoof your country via VPN, if you wish.
By using this site, you allow us to collect information about your browser and operating system. This is to help us improve our services. We do not collect your IP address.
The purposes of data collected, as well as its requested specifications, are clearly stated prior to collection. All data is collected lawfully and under the knowledge of the user. The user chooses whether or not to enter any requested data.
We retain collected data in order to fulfill stated purposes and make the data available, at any time, to the originating user. Information can be make available to other users under the consent of the originating user.
All information entered remains the property of the originating user. We take no responsibility for the content of collected data.
We are committed to obey laws set out by the governments of British Columbia and Canada. As such, we reserve the right to disclose information when required by law.
We take reasonable measures to safeguard collected data from unauthorized access. However, we do not take responsibility for theft or loss of data beyond our control.
We take reasonable measures to allow the user to modify and delete the majority of data that they entered. However, we reserve the right not to allow such modification or deletion.
By using our services, you allow the Yearbook Labs Co. team to view data you enter for product development and support. In other words, we do not browse through your data at leisure, but rather, when we test our services (or when you ask for technical support), we would much rather use real, user-generated data instead of randomly-generated ones. This enables us to better prepare for boundary cases.
All text-based data collected is hosted by MyHosting and held in Equinix and Earthlink Enterprise Data Centers located in Toronto, Ontario, Canada and Rochester, New York, USA respectively. All file-based data is held in the aforementioned data centers, as well as Microsoft servers in Western US and Parse/Facebook/Amazon servers in Eastern US.
